Overview

Welcome to PedTerra LLC (“PedTerra,” “we,” “us,” “our”). We operate this store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). The store is powered by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”) together with any policies referenced here (including our Privacy Policy and Return Policy) describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, do not use the Services.

1. Access and Account

1.1 Eligibility. You represent that you are at least the age of majority in your state or province of residence and have authority to agree to these Terms.
1.2 Account info. To use certain features (including checkout), you may need to provide information such as your email address, billing, payment, and shipping information. You warrant this information is accurate and complete and that you have all necessary rights to provide it.
1.3 Security. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You may not transfer or license your account to any other person.

2. Products and Content

2.1 Display. We make reasonable efforts to describe and depict products accurately, but the appearance (including color) may vary due to device settings.
2.2 Changes. Product descriptions, availability, sizing, and pricing may change at any time without notice. We may discontinue any product or limit quantities for any person, household, or order.

3. Orders

3.1 Offer and acceptance. Your order is an offer to buy. We may accept or reject any order for any reason. An order is accepted when we send a confirmation and process payment.
3.2 Cancellations/changes. Once an order is accepted, we may be unable to accommodate cancellation requests. If we change or cancel an order, we will contact you using the information provided at checkout.
3.3 Personal use. You represent that purchases are for personal or household use and not for resale or export unless we agree in writing.
3.4 Returns. Your purchases are subject to our Return/Refund Policy [LINK], which is incorporated into these Terms.

4. Prices, Taxes, and Billing

4.1 Prices. Prices, discounts, promotions, and shipping rates are subject to change without notice. The price at checkout is the price in effect at the time of order. Unless stated otherwise, prices exclude taxes, shipping/handling, duties, and import charges.
4.2 Promotions. Promotional terms may govern and, in case of conflict, will control over these Terms for that promotion.
4.3 Billing accuracy. You agree to provide current, complete, and accurate purchase and account information and to promptly update it so we can complete your transactions and contact you as needed.
4.4 Authorization. You warrant that (i) the payment method is valid and authorized, (ii) charges will be honored by your payment provider, and (iii) you will pay all amounts due, including applicable taxes and shipping.

5. Shipping, Delivery, and Risk of Loss

5.1 Fulfillment. Orders are fulfilled and shipped by our U.S. logistics partner, Reality Fulfillment Services LLC (DeKalb, Illinois), using carriers selected in our discretion (e.g., UPS, USPS).
5.2 Processing times. Weekday orders typically ship within 24 hours; orders placed after 2:00 PM CST or on weekends/holidays ship the next business day. Mondays are our busiest day; some weekend orders may ship Tuesday morning.
5.3 Delivery estimates. Any delivery times shown are estimates only and are not guaranteed. We are not liable for delays caused by carriers, weather, customs, or events beyond our control.
5.4 Title and risk. Title and risk of loss transfer to you when we deliver the package to the carrier.

6. Returns and Refunds

6.1 Policy. Returns are governed by our Return/Refund Policy [LINK].
6.2 Window and condition. Unless stated otherwise, returns must be initiated within 14 days of delivery, and items must be unworn, undamaged, and in original packaging.
6.3 Processing. Once received and inspected, eligible refunds are issued to the original payment method. Shipping charges are non-refundable unless required by law.
6.4 Late returns. Returns outside the published window may be declined or, at our discretion, issued as store credit or exchange.

7. Errors, Inaccuracies, and Availability

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions (including regarding descriptions, pricing, promotions, shipping charges, transit times, and availability). We reserve the right to correct, change, or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submitted your order).

8. Intellectual Property

The Services and all content (including text, graphics, logos, product images, videos, and their selection and arrangement) are owned by PedTerra LLC, its affiliates, or its licensors and are protected by U.S. and international laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any content without our prior written permission. All trademarks, trade dress, and service marks are the property of their respective owners. No rights are granted by implication or estoppel.

9. Optional Tools and Third-Party Links

We may provide access to tools, features, or content operated by third parties. These are provided “as is” and “as available,” without warranties. Your use of third-party tools or websites is at your own risk and subject to their terms and policies. We are not responsible for any third-party sites, products, services, or content.

10. Relationship with Shopify

PedTerra LLC is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases in our store are made directly with PedTerra LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PedTerra LLC, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with PedTerra LLC.

11. Privacy

Personal information we collect through the Services is handled in accordance with our Privacy Policy [LINK]. Because the Services are hosted by Shopify, certain personal information may also be processed by Shopify as described in Shopify’s privacy documentation. By using the Services, you acknowledge those privacy disclosures.

12. Feedback and Reviews

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display the Feedback for any lawful purpose. You represent you have all rights necessary, and your Feedback will comply with these Terms and applicable law.

13. Prohibited Uses

You agree not to: (a) use the Services for unlawful, fraudulent, or malicious purposes; (b) violate any applicable law; (c) infringe the rights of others; (d) harass, abuse, or harm any person; (e) upload malware; (f) scrape, crawl, or attempt to extract data without permission; (g) interfere with security features or network operations; or (h) use the Services to send spam or misleading communications. We may suspend or terminate access for any violation.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including IP, Feedback, Warranty Disclaimer, Limitation of Liability, Indemnification, Governing Law/Dispute Resolution) will survive.

15. Disclaimer of Warranties

Except as expressly stated by PedTerra LLC in writing, the Services and all products offered through the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

16. Limitation of Liability

To the fullest extent permitted by law, in no event will PedTerra LLC, its affiliates, officers, employees, agents, suppliers, or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenues, or data; replacement costs; or similar damages, arising out of or related to your use of the Services or products, whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility. Our maximum aggregate liability for any claims arising out of or relating to the Services or any products is limited to the amount you paid for the product that gave rise to the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless PedTerra LLC (and Shopify), and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, violation of law, or misuse of the Services.

18. Governing Law; Dispute Resolution

18.1 Governing law. These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles.
18.2 Venue; informal resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at heretohelp@pedterra.com.

19. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

20. Waiver; Entire Agreement; Assignment

Our failure to enforce any provision is not a waiver. These Terms, together with policies referenced here (including the Privacy Policy and Return Policy), are the entire agreement between you and PedTerra LLC regarding the Services and supersede prior agreements. You may not assign your rights or obligations without our prior written consent; we may assign these Terms without notice.

21. Changes to These Terms

We may update these Terms at any time by posting a revised version with a new “Last updated” date. We will provide notice of material changes as required by law. Your continued use of the Services after changes become effective constitutes acceptance.
